Terms of use

The agreement between you and FrameClub: what you may publish, and what we owe each other.

What this covers

These terms govern the use of https://frameclub.club and everything on it. Creating an account means accepting them. If you do not accept them, do not create an account.

FrameClub is a community platform where filmmakers publish their work, credit the people they worked with, and discover what others are making. Using it is free.

Your account

Anyone can sign up. You must be at least 16 years old, and you undertake to give a real name and a valid email address.

One account per person. It is personal, it is not transferable, and you are answerable for everything done through it. Keep your password to yourself and tell us if you believe someone else has it.

You may close your account whenever you want, from your settings, without giving a reason.

What you publish

Your work stays yours. Publishing it on FrameClub transfers no ownership.

By publishing, you warrant that you hold every right needed for it to be shown publicly, and in particular that:

  • you are the author of the work, or you have the authorisation of those who are;
  • the music, footage, images, fonts and effects it contains are cleared for online publication, or covered by a licence that allows it;
  • the people appearing in it have consented to their image being published;
  • the client or agency, where the work was commissioned, allows it to be shown.

Music is where this goes wrong most often. A commercial track cleared for a television campaign is not thereby cleared for online publication. If you are unsure, publish through YouTube, whose Content ID handles the royalties, or take the video down until you have checked.

You remain responsible for what you publish, and you will bear the consequences of a claim from a rights holder about it. FrameClub does not clear rights on your behalf and does not check them before publication.

The licence you grant us

To be able to show your work, we need your permission. You grant FrameClub a non-exclusive, worldwide, royalty-free licence to host, encode, display, and reproduce what you publish, for as long as it is published.

That licence is limited to running and promoting the platform: showing your work on the site, in embeds you enable, in selections such as Handpicked, and in FrameClub's own communications — its social accounts and newsletter — where your work is always credited to you.

It gives us no right to sell your work, to license it to a third party, or to alter it beyond the technical processing that publishing requires: encoding, resizing, thumbnails, previews.

Deleting a video ends the licence. Copies already shared or embedded elsewhere are beyond our reach, and cached copies may survive for a short while.

Credits

Crediting the people who made the work is the point of FrameClub. Credit accurately: credit those who did the work, in the role they held, and do not credit yourself for work you did not do.

Anyone credited may ask for a credit to be corrected or removed, whether or not they are a member. A member can request a change through the edit request feature; anyone else can write to us.

What is not allowed

Do not publish, and do not use FrameClub to distribute:

  • work that is not yours and that you have no authorisation to publish;
  • content that is unlawful, defamatory, hateful, harassing, or that infringes someone's privacy or image rights;
  • pornographic content, or violent content published for its own sake;
  • advertising, mass solicitation, or content published to promote something other than creative work;
  • malicious software, or anything meant to disrupt the service or reach data you have no right to.

Do not scrape the platform, overload it, or circumvent its technical limits. Automated access outside of what the interface provides is not permitted.

Moderation

FrameClub is a host: work is published without prior review. We do act on what is reported, and we may also intervene on our own initiative.

Every video carries a Report control. You can also write to hello@frameclub.club.

We may remove content that breaches these terms or the law, and suspend or close an account that does so seriously or repeatedly. Except where the breach is manifest or urgent, you are told what was removed and why, and you can reply.

The service itself

We do our best to keep FrameClub available and working, without promising it will never be interrupted. Maintenance, provider failures and bugs happen, and we may change features, add them, or withdraw them.

FrameClub is not an archive. Keep your own masters: we make no commitment to retain a copy of your work, and losing your only copy is not a risk this platform is built to carry.

If the service is to close down for good, members are told with enough notice to retrieve their work.

Liability

As a host, FrameClub is not liable for content published by its members before being notified of it. Once notified of manifestly unlawful content, we act promptly.

Nothing here limits our liability for gross negligence, wilful misconduct, or for personal injury. Nothing here removes the rights French law gives you as a consumer.

Ending the agreement

You may delete your account at any time. We may close an account that seriously breaches these terms, after telling you, unless the breach makes immediate action necessary.

What happens to your data on deletion is set out in the privacy policy.

Changes to these terms

These terms may change as the platform does. A substantive change is announced by email at least 30 days before it takes effect. If you disagree with it, you may close your account before then.

Governing law

These terms are governed by French law.

Any difficulty is best raised with us first, at hello@frameclub.club. If a dispute remains, the courts having jurisdiction are those designated by the rules of French civil procedure.
